2. Products and Pricing
Authenticity: Potent guarantees that all electronic products sold are 100% authentic and sourced from authorized distributors.
Price Fluctuations: Prices for our products are subject to change without notice to account for market demand and currency exchange rate volatility (KES/USD).
Sales Limitations: We reserve the right to limit the quantities of any products or services that we offer to any person, geographic region, or jurisdiction.
3. Payment Terms
Accepted Methods: We accept M-Pesa (Till Number), Bank Transfers, and Credit/Debit Cards.
Verification: Orders are only processed once payment is fully verified. For high-value transactions, we may request additional identification to prevent fraud.
Ownership: Ownership of the goods passes to the customer only upon full payment of the purchase price.
4. Shipping and Delivery
Regional Delivery: Standard delivery within the Nairobi Metropolitan area is conducted within 24 hours of order confirmation.
National Shipping: We facilitate shipping across Kenya via reputable logistics partners. While we prioritize secure packaging, Potent is not liable for logistical delays or service interruptions caused by third-party carriers.
Risk Transfer: The risk of loss and title for such items pass to the customer upon our delivery of the package to the carrier.
5. Warranty and Liability
Manufacturer Warranty: New devices are covered by the respective manufacturer’s limited warranty. Technical support and hardware repairs are facilitated through Authorized Service Centers.
Limitation of Liability: Potent shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products.
Inspection Policy: It is the customer’s sole responsibility to inspect the device and its physical condition immediately upon delivery or collection.
6. Trade-In Program
Technical Valuation: Any preliminary valuations provided via digital channels are estimates only. A binding trade-in value is only issued after a comprehensive physical and technical diagnostic at our Service Hub.
Data Clearance: Customers must back up and perform a factory reset on all trade-in devices. Potent assumes no responsibility for the loss or recovery of personal data.
7. Returns and Refunds
All returns are governed by our specific Refund and Return Policy. Please be advised that breaking the manufacturer’s seal on a device significantly impacts its resale value; such items may be subject to a restocking fee or rejection of the return request.
8. Privacy Policy
Your submission of personal information is governed by our Privacy Policy. We are committed to data protection and do not share your information with third parties, except for essential service providers such as payment processors and delivery couriers.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the Laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the Kenyan courts.
